By accessing or using our Site or services, you agree to be bound by these Terms and our Privacy Policy, which is incorporated by reference into these Terms. If you do not agree to all of these Terms, do not access or use our Site or services.
1. Acceptance of Terms
You affirm that you are 18 years of age or older, or an emancipated minor, or possess legal parental or guardian consent, and are fully able and competent to enter into the terms, conditions, obligations, affirmations, representations, and warranties set forth in these Terms, and to abide by and comply with these Terms. If you are under 18, you may only use our services with the involvement of a parent or guardian.
2. Services Offered
[Your Business Name] provides music lessons, including but not limited to group, semi-private and private guitar, piano, voice, drumset, violin and viola lessons, through various formats, which may include in-person, online, or hybrid instruction. We reserve the right to modify or discontinue any part of our services at any time without prior notice.
3. User Accounts
Account Creation: To access certain features of our services, you may be required to create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
Account Security: You are responsible for maintaining the confidentiality of your account login information and are fully responsible for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security. We will not be liable for any loss or damage arising from your failure to comply with this section.
4. Payments and Billing
Fees: You agree to pay all fees and charges for services purchased from Skyline Music Studio according to the pricing and payment terms presented to you at the time of purchase. All prices are in USD unless otherwise stated.
Payment Methods: We accept various payment methods such as card, check, cash, Venmo and ACH Bank Transfer. You authorize us to charge your chosen payment method for all services purchased and for any applicable taxes.
Refunds and Cancellations: Our refund and cancellation policy is as follows: It is required that the first month be paid in full before lessons can begin. We prefer to help you set up your account and payment info in person. Moving forward, tuition will be the same regardless of the number of lessons during the month. There will be no refunds for missed lessons, though class may be extended past the agreed 12 weeks to ensure that each student finishes the course at the teacher’s discretion. The day that tuition is due can be found in your invoice. A $15 no-show fee will be charged for any lesson not cancelled 48 hours in advance of the regularly scheduled lesson time.
Late Payment- A $5 late fee will be applied to the tuition if it is more than 7 days late. We strongly encourage you to use our automated payments to avoid these fees, though we do accept all forms of payment. Leave payment with your teacher the first day of class if you are not using online payment.
5. Acceptable Use
You agree not to use the Site or services to:
Violate any applicable local, state, national, or international law or regulation.
Infringe upon the rights of others, including but not limited to intellectual property rights and privacy rights.
Transmit any unlawful, threatening, abusive, libelous, defamatory, obscene, vulgar, pornographic, profane, or indecent information of any kind.
Transmit any material that constitutes or encourages conduct that would constitute a criminal offense, give rise to civil liability, or otherwise violate any law.
Interfere with or disrupt the operation of the Site or services, or the servers or networks connected to the Site or services.
Attempt to gain unauthorized access to any portion or feature of the Site, or any other systems or networks connected to the Site or to any of our servers, or to any of the services offered on or through the Site, by hacking, password "mining," or any other illegitimate means.
Engage in any form of "spamming," "phishing," or similar activities.
6. SMS/MMS Messaging (A2P 10DLC Compliance)

Please read the following carefully:
Opt-In: You will only receive SMS/MMS messages if you explicitly opt-in. This opt-in may occur through a website form, in-person sign-up, or by texting a keyword to our designated short code or long code.
Message Frequency: Message frequency will vary depending on your lesson schedule and specific interactions with us. We aim to keep messages relevant and non-excessive.
Costs: Message and data rates may apply from your mobile carrier. Please check with your mobile carrier for details.
STOP to Opt-Out: You can opt-out of receiving SMS/MMS messages at any time by replying "STOP" to any message you receive from us. After you send the message "STOP" to us, we will send you a reply message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time or text "START" to the same number, and we will start sending SMS messages to you again.

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Site or provided through our services without our prior written consent, except as follows:
Your computer may temporarily store copies of such materials in RAM incidental to your accessing and viewing those materials.
You may store files that are automatically cached by your Web browser for display enhancement purposes.

11. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the State of [Your State, e.g., Utah], without regard to its conflict of law principles. WEEKLY STUDENT EXPECTATIONS- It is important to the success of each student in class each week to arrive on time, with the required materials for class. If there is a conflict, it is the student’s (or parent/guardian’s) responsibility to notify the teacher (either via text or through cancelling via email) a minimum of 24 hours in advance. If this does not occur by the specified time period, a $15 “no show” fee may be applied per occurrence. The Studio reserves the right to waive this fee at the Studio’s discretion, depending on the good standing of the client and the circumstances surrounding the miscommunication. At the teacher’s discretion, they may reschedule the missed lesson for another day of the same week, provided that they were given 48 hour notice as previously mentioned.
WEEKLY TEACHER EXPECTATIONS- Teachers are expected to arrive on time, with the required materials for class. If there is a conflict in their schedule, they are expected to let you know via cancelling in the calendar AND text message a minimum of 24 hours in advance. In the event that this does not occur, you will not be held financially responsible for that lesson, either by extending your contract, OR you will be refunded the value of the missed lesson if this is the last month of the contract. If your teacher does not communicate effectively, please let Kayden know!
TUITION EXPECTATIONS- It is required that at least the first month be paid in full before lessons can begin. We prefer to help you set up your account and payment info in person. Moving forward, tuition will be the same regardless of the number of lessons during the month. There will be no refunds for missed lessons, though class may be extended past the agreed 14 weeks to ensure that each student finishes their contract at the teacher’s discretion. The day that tuition is due can be found in your invoice. A $5 late fee will be applied to the tuition if it is more than 7 days late. We strongly encourage you to use our automated payments to avoid these fees, though we do accept all forms of payment. Leave payment with your teacher the first day of class if you are not using online payment. Students will be held financially responsible for the ENTIRETY of their current contract with the following exceptions: 1) They move more than 25 miles away from a SMS location, 2) The Studio reserves the right to end a contract early at their discrestion.
COURSE EXPECTATIONS- It is the parents’ responsibility to make sure that each student has the required materials for the course they are taking. A list of these will be provided to you. We start folks off with a 14 week trial semester, then extend to a 12 month program if they wish to continue, and after this clients may choose to extend in either 3, 6, or 12 month contracts depending on their goals and interests. It is expected that students take lessons for the entirety of the current contract, and each student will be held financially responsible for the full time, regardless of how many lessons they attend. The Studio reserves the right to prorate or waive tuition at their discretion, depending on the circumstances for each student.
WHAT IF WE WANT TO TAKE SOME TIME OFF?- Great question! Your payments will continue for as long as specified (3 or 12 consecutive months depending on the program), but you can pause lessons in increments of one month, just let us know before the month starts if you want to take the time off! As an extreme example, if you are paying for our 12 month program, you could do one month of lessons once a month for 12 years as long as you let us know in advance!
WHAT IF WE WANT TO SWITCH TO PRIVATE/TRY A DIFFERENT INSTRUMENT OR PROGRAM?- This is totally understandable, and given that you have done at least 12 weeks on your current instrument/style, you may switch to private lessons, a different class or program. If you are currently paying the group tuition rate and we switch to a program that is more expensive, we just ask that you pay the difference in tuition.
STOPPING LESSONS- We strongly encourage folks to finish out the programs they are currently working through. Cultivating persistence in our students is one of the most valuable things we can provide! However, it is within our discretion to cancel remaining payments you have if you move more than 25 miles away from one of our locations, or if a significant life event that prevents lessons from continuing occurs.
CARE FOR FACILITIES- Though the facilities are a work in progress, we do ask that students treat them with respect. Any damage caused by students will result in immediate dismissal, and they or their parent/guardian will be held financially responsible.
STUDENT SHOWCASES- Performances are optional but highly encouraged! We do charge admission, to get in for those over 12 that are not performing, it is a big production and my goal with each concert is to break even 🙂
STUDENT SUCCESS- Parents can come to lessons as often as they would like to, we recommend at least monthly, if possible. We also recommend helping your student find a specific time to practice, uninterrupted 3-5x a week. What they should practice and for how long will be specified on their Practice Plan. Please let Kayden know if your student is not getting one of these every week (They can be found in Skool for those taking a group course).
